A mandatory Pre-Bid Conference will be held on November 12, 2025, at 10:00 A.M.
Separate sealed Bids for the construction of the Pocahontas Waterline Replacement Project for the Tazewell County PSA, which consists of the replacement of existing waterlines in the Yards, Nemours, and Wolfe communities in Mercer County, West Virginia. In addition, the water lines will be upgraded to allow for the installation of fire hydrants. The Project consists of constructing:
CONTRACT NO. 1 – will consist of approximately 12,750 L.F. of 8-inch water main, 13,700 L.F. of 6-inch water main, 3,900 L.F. of 2-inch water main, 3,000 L.F. of service lines, 104 Meters and Settings, 100 Service reconnections, 4 Service relocations, valves, hydrants, and all appurtenances.
CONTRACT NO. 2 – will consist of approximately 8,800 L.F. of 8-inch water main, 11,300 L.F. of 6-inch water main, 8,600 L.F. of 4-inch water main, 4,600 L.F. of 2-inch water main, 3,300 L.F. of service lines, 49 Meters and Settings, 47 Service reconnections, 2 Service relocations, bridge modifications, valves, hydrants, and all appurtenances.
CONTRACT NO. 3 – will consist of either the rehabilitation or replacement of a 250,000-gallon water storage tank (Yards Storage Tank) and all appurtenances.
CONTRACT NO. 4 – will consist of either the rehabilitation or replacement of a 225,000-gallon water storage tank (Shop Hollow Storage Tank) and all appurtenances.
Bids will be received by Tazewell County Public Service Authority at their office located at 168 Tazewell Mall Circle, Tazewell, Virginia 24651 until 1:30 P.M., local prevailing time, on December 4, 2025, and then at said office publicly opened and read aloud.
The Contract Documents may be examined at the Tazewell County PSA office at 168 Tazewell Mall Circle, Tazewell, Virginia 24651; at the office of Thompson & Litton, 1105 Mercer Street, Princeton WV; and online at TRASCO (http://www.trascoplanroom.com); Contractors Association of WV, 2114 Kanawha Boulevard, East Charleston, WV 25301; and F.W. A mandatory Pre-Bid Conference will be held on November 12, 2025, at 10:00 A.M. All interested parties are required to meet the Engineer at the Tazewell County Public Service Authority office located at 168 Tazewell Mall Circle, Tazewell, Virginia 24651at that time and can be accessed using the following weblink: “https://www.microsoft.com/en-us/microsoft-teams/join-a-meeting” and utilize meeting ID 284 065 953 780 and pass code hH3K53hz. Following the conference, a field review of the project area will be held for all BIDDER’s.
Prospective Bidders should note that these contract(s) will include the following critical requirements as identified in the contract documents:
1. Affirmative Action Program Requirements and Goals
2. Certification of Non-Segregated Facilities
3. Specific Labor Standard Provisions
4. WV Contract Licensing Act – All bidders are required to have a WV Contractor’s License per Section 30-42-12 of the WV Code.
5. American Iron and Steel Requirement – P.L. 113-76, Section 436
6. Infrastructure Investment and Jobs Act, Build America Buy America Requirements - P.L. 117-58
Withdrawal of bids shall be according to procedure (i) of the Virginia Public Procurement Act and to the Code of Virginia (§ 2.2-4330). No Bidder may withdraw their bid within 90 days after the actual date of the opening thereof.
A Bid Bond executed by the BIDDER and a grantee Bidder and a Bidder, surety company approved by the Grantee, in the amount equal to five percent (5%) of the Bid, shall be submitted with each Bid, to guarantee the BIDDER’s entrance into a Contract, if given the award, No Bid Bond shall be waived or returned because the BIDDER failed to or cannot comply with any requirements as set forth in Plan, Specifications, or any applicable statues of the United States, the State of West Virginia and/or local ordinances.
Each Bidder must submit with their bid, security in the amount, form, and subject to the conditions provided for in the Information for Bidders.
All Bidders are required to have a West Virginia Contractor’s License per Section §30-42-12 of the West Virginia Code.
Each Bidder must be licensed as a Class A contractor in the State of Virginia; Bidders are instructed to review the Code of Virginia, Title 54.1, Chapter 11, prior to bidding.
The Owner does not discriminate against faith-based organizations in accordance with the Code of Virginia, § 2.2-4343.1.
MBE/WBE firms are encouraged to submit bids. Bidders must comply with the following: the President’s Executive Order # 11246 prohibiting discrimination in employment regarding race, color, creed, sex, or national origin; the President’s Executive Orders # 12138 and 11625 regarding utilization of MBE/WBE firms; the Civil Rights Act of 1964; the Davis-Bacon Act; and Section 70901 of P. L. 117-58 of the Bipartisan Infrastructure Law, 2021. Bidders must certify that they do not or will not maintain or provide for their employees any facilities that are segregated on the basis of race, color, creed, or national origin.
NONDISCRIMINATION IN EMPLOYMENT
BIDDER’s on this work will be required to comply with President’s Executive Order No. 11246 entitled “Equal Employment Opportunity” as amended by Executive Order 11375 and “HUD Section 109” which prohibits discrimination in employment regarding race, creed, color, sex or national origin, and requires certification of non-segregated facilities.
BIDDER’s must comply with Title VI of the Civil Rights Act of 1964, the Davis-Bacon Act, the Anti-Kickback Act, the Contract Work Hours and Safety Standards Act, and the West Virginia Division of Labor Wages for Construction of Public Improvements pursuant to West Virginia Code §21-5A-3.
Any CONTRACTOR submitting a Bid on this project hereby certifies, indicates and acknowledges that he/she has a license and meets all the qualifications required by the statutes of the State and subdivision in which the work is to be performed.
AMERICAN IRON AND STEEL REQUIREMENT
P.L. 113-76, Consolidated Appropriations Act, 2014 (Act), includes an “American Iron and Steel (AIS)” requirement in section 436 that requires Clean Water State Revolving Loan Fund (CWSRF) and Drinking Water State Revolving Loan Fund (DWSRF) assistance recipients to use iron and steel products that are produced in the United States for projects for the construction, alteration, maintenance, or repair of a public water system or treatment works.
SUSPENSION AND DEBARMENT
Recipient shall not entertain the use of businesses that are listed on the “System for Award Management (SAM)” at www.sam.gov in accordance with 2 CFR Part 1532 and Subpart B and C of 2 CFR Part 180.
WV ALCOHOL AND DRUG FREE WORKPLACE ACT
West Virginia code 21-1d-5 provides that any solicitation for a public improvement construction contract requires each vendor that submits a bid for the work to submit at the same time an affidavit of compliance with the bid. The enclosed drug-free workplace affidavit must be signed and submitted in the first envelope as evidence of the vendor’s compliance with the provisions of article 1d, chapter 21 of the West Virginia code. Failure to submit the signed drug-free workplace affidavit in the first envelope shall result in disqualification of such bid.
NOTICE OF FEDERAL WAGE REQUIREMENTS
Contractors are required to comply with all laws pertaining to federal wage rates as issued in accordance with the Davis Bacon Act. The contractor will be required to pay the federal wage rates appropriate for each worker classification.
The Contract(s) shall be awarded to the lowest responsive and responsible Bidder(s).
Any contract or contracts awarded under this invitation for bids are expected to be funded in part by grants and loans from: the West Virginia Department of Environmental Protection State Revolving Fund, Virginia Department of Health, West Virginia Infrastructure and Jobs Development Council, and Mercer County Commission. Neither the United States, the State of West Virginia, State of Virginia, Mercer County Commission, nor any of their departments, agencies or employees are or will be a party to this invitation to bid or any resulting contract.
“The Tazewell County Public Service Authority and the Mercer County Public Service District are exempt from West Virginia Sales Taxes and, by West Virginia Code §11-15-8d, can now extend this tax exemption to Contractors supplying goods on their behalf. The Contractor shall coordinate with the Tazewell County Public Service Authority and the Mercer County Public Service District the filing of any and all applications to the State of West Virginia, exempting the purchase of the specified Goods from West Virginia Sales Tax and hereby agrees to include the savings from such sales tax exemption in its total base bid.”
